For college financial aid purposes, a non-custodial parent is defined as a parent (biological or adoptive) with whom you do not live. If you split your time between two different parents, your non-custodial parent is the parent with whom you live less than 50% of the time. If you live with each parent exactly 50% of the year, determine which parent would best be described as your primary parent, and designate the other as your non-custodial parent. The term “non-custodial parent” for these purposes is not necessarily related to who has legal custody.
